by accessing or using thesaybrand.com, you agree to be bound by these terms. if you don't agree, please don't use the site.

1. use of this site

this site is owned and operated by say brand. you may browse, view, and make purchases for personal, non-commercial use. you agree not to misuse the site, interfere with its functionality, or attempt to access it through unauthorized means.

2. products & orders

all product descriptions, images, and pricing are provided in good faith and are as accurate as possible. we reserve the right to correct errors and to cancel or refuse any order where an error in pricing or description has occurred.

once an order is placed, you will receive a confirmation email. this does not guarantee acceptance of your order. we reserve the right to cancel orders for any reason, including stock limitations. if we cancel an order you have paid for, we refund you in full.

3. pricing & payment

all prices are listed in USD. we pay for shipping within the united states. payment is processed through our secure checkout provider (stripe). we do not store your payment information directly.

4. shipping & delivery

once an order ships, delivery times are estimates and are not guaranteed. we are not responsible for carrier delays, weather, customs, or other events outside our control. this does not limit your right in section 5 to cancel if we do not ship by the date or within the window stated when you paid. your order is our responsibility until it is delivered. if it doesn't arrive, tell us and we will look into it with the carrier first. if it turns out to be lost, we refund you in full. an item that arrives damaged or defective, or is not what you ordered, is refunded as described in section 5.

5. returns

you may return any item except a preorder (see below) within 15 days of delivery, for any reason, for a full refund. an item is returned within the 15 days if it is sent back on or before the fifteenth day after delivery. it must be unworn and unwashed, with tags attached, and return shipping is paid by the buyer.

if an item arrives damaged or defective, or is not what you ordered, email ask@thesaybrand.com within 7 days of delivery with your order number and a photo of the problem, and we will refund you in full and pay for the return. the unworn, unwashed and tags-attached conditions above do not apply to this case. after 7 days, an item with one of these problems can still be returned within the 15 days above, on the terms stated there, unless it is a preorder. nothing in this section limits your rights under the law for a defect that becomes apparent later, preorders included.

we do not offer exchanges or replacements. to get a different size, return the item for a refund and place a new order (a preorder can't be returned for size; see below). to start a return, email ask@thesaybrand.com with your order number. refunds are processed to the original payment method within 5–10 business days of receiving the returned item.

a preorder is an item paid for in advance and made after the order is placed. because it is made to order, a preorder is final sale: it cannot be returned for a change of mind or to get a different size, and the 15-day return above does not apply to it. an item that arrives damaged or defective, or is not what you ordered, is refunded as described above, preorders included.

a reservation is an item paid for in advance, before it is available to ship. reservations are returnable on the same terms as any order, with the 15 days counted from delivery.

for a preorder or a reservation, if we cannot ship within the ship window or by the ship date stated at the time of purchase, or are unable to make and ship the item at all, you may cancel for a full refund.

nothing in these terms limits any rights you have under the law.

6. intellectual property

all content on this site — including text, images, logos, designs, and the PRESENT™ wordmark in both its typed and cursive forms, as used on our products — is the property of say brand® and is protected by applicable intellectual property laws. you may not reproduce, distribute, or create derivative works without written permission. claims of infringement to ask@thesaybrand.com.

7. limitation of liability

say brand is not liable for any indirect, incidental, or consequential damages arising from the use of this site or our products. our products are cues, not medical devices. they are not intended to diagnose, treat, cure, or prevent any condition.

8. privacy

your use of the site is also governed by our privacy policy.

9. changes to these terms

we may update these terms from time to time. continued use of the site after changes constitutes acceptance of the updated terms.

10. governing law

these terms are governed by the laws of the state of illinois, united states.
