by accessing or using thesaybrand.com, you agree to be bound by these terms. if you don't agree, please don't use the site.

1. use of this site

this site is owned and operated by say brand. you may browse, view, and make purchases for personal, non-commercial use. you agree not to misuse the site, interfere with its functionality, or attempt to access it through unauthorized means.

2. products & orders

all product descriptions, images, and pricing are provided in good faith and are as accurate as possible. we reserve the right to correct errors and to cancel or refuse any order where an error in pricing or description has occurred.

once an order is placed, you will receive a confirmation email. this does not guarantee acceptance of your order. we reserve the right to cancel orders for any reason, including stock limitations.

3. pricing & payment

all prices are listed in USD. payment is processed through our secure checkout provider (stripe). we do not store your payment information directly.

4. shipping & delivery

shipping times are estimates and are not guaranteed. we are not responsible for delays caused by carriers, weather, customs, or other events outside our control. risk of loss passes to you upon delivery to the carrier.

5. returns

we accept returns within 15 days of delivery for unworn, unwashed items with all original packaging. return shipping is paid by the buyer, except where the item arrives damaged or defective or the wrong item was sent, in which case we pay the return shipping. refunds are processed to the original payment method within 5–10 business days of receiving the returned item.

preorders are final sale for change of mind. a preorder is an item paid for in advance and made after the order is placed; it is not refundable or returnable where the buyer changes their mind. this does not apply where the item arrives damaged or defective or the wrong item was sent, in which case the buyer may choose a replacement or a full refund and we pay shipping both ways. if we cannot ship within the ship window stated at the time of purchase, or are unable to make and ship a preorder at all, you may cancel for a full refund.

6. intellectual property

all content on this site — including text, images, logos, designs, and the PRESENT™ wordmark in both its typed and cursive forms, as used on our products — is the property of say brand® and is protected by applicable intellectual property laws. you may not reproduce, distribute, or create derivative works without written permission. claims of infringement to hello@thesaybrand.com.

7. limitation of liability

say brand is not liable for any indirect, incidental, or consequential damages arising from the use of this site or our products. our products are cues, not medical devices. they are not intended to diagnose, treat, cure, or prevent any condition.

8. privacy

your use of the site is also governed by our privacy policy.

9. changes to these terms

we may update these terms from time to time. continued use of the site after changes constitutes acceptance of the updated terms.

10. governing law

these terms are governed by the laws of the state of illinois, united states.
